David is a Shareholder in the firm's Litigation section and co-chairs the firm's Bankruptcy, Restructuring and Creditors' Rights practice group. His practice focuses on bankruptcy generally, with an emphasis on the representation of distressed businesses and business owners. In addition to his debtor practice, David routinely represents lenders, developers, landlords and other entities as creditors in bankruptcy and workout proceedings. He has served as court-appointed receiver for a variety of Virginia corporations and has represented unsecured creditors' committees and trustees in many Chapter 11 and other bankruptcy proceedings. In 2004, David earned his certification in business bankruptcy law from the American Board of Certification, an affiliate of the American Bankruptcy Institute.* David also handles a wide variety of commercial litigation matters including commercial collections and advises clients on general business matters and asset protection strategies.
Relevant Experience:
- Reorganized a wide array of businesses through Chapter 11 and achieved dozens of confirmed plans of reorganization
- Represented Unsecured Creditors' Committee in reorganizaiton of telecom company
- Appointed by Virginia Office of the Attorney General as a receiver for four Virginia corporations
- Represented owner of construction company in dischargeability litigation brought by substantial creditor, resulting in discharge of all contested claims and published bankruptcy court opinion
- Appointed by Virginia Circuit Court and served as custodian pendente lite for 75-year old Virginia company, resulting in 100% payout to trade creditors and substantial returns to equity holders
- Represented Chapter 7 bankruptcy trustee in multi-million dollar adversary proceeding against international defendant
- Represented informal committee of landlords in Chapter 11 of national retail chain
- Represented "Fortune 100" company in succssful acquisition of "pipeline assets" in large Chapter 11 case
- Represented numerous secured and unsecured lenders in wide variety of bankruptcy proceedings
